Reglas Oficiales/Bases del Sorteo

1.INFORMACIÓN GENERAL: NO ES NECESARIO COMPRAR. No es válido afuera del área geográfica terrestre de recepción de la señal de transmisión de KXTX y donde esté prohibido. El Sorteo comienza el 26 de abril a las 6.00 de la mañana y finaliza el mismo 26 de abril 2008 a las 10.00 de la mañana (“el “Período del Sorteo”). Todas las horas de este Sorteo están indicadas como Hora(s) del Centro de los EE.UU. Las probabilidades de ganar dependen del número de inscripciones elegibles recibidas.

2. PARA INSCRIBIRSE: visite el pabellón de Telemundo 39 y NBC5 durante el evento de “Race for The Cure” en el Sundance Square del centro (Downtown) de Fort Worth y complete el formulario de inscripción que incluye su/s nombre(s) y apellido(s), dirección, número de teléfono, dirección de correo electrónico y demás información. Una vez completado, el formulario de inscripción debe ser colocado en el buzón de recepción de inscripciones del Sorteo que estará ubicado en el pabellón. Todas las inscripciones pasan a ser propiedad de KXAS-TV, KXTX-TV, Telemundo 39, Susan G. Komen, Telemundo Network Group LLC, y NBC Universal, Inc., (los “Patrocinadores”) no se acusará su recibo ni serán devueltas. Las inscripciones deberán ser recibidas, a más tardar antes de las 10.00 de la mañana del 26 de abril 2008 para ser elegibles al Sorteo. Puede inscribirse una vez por día durante el Periodo del Sorteo. Las inscripciones múltiples recibidas de cualquier persona o correo electrónico después de una primera inscripción, quedarán anuladas. Las inscripciones generadas por guión, subrutinas automatizadas de software o métodos similares serán descalificadas. Las inscripciones incompletas, alteradas, corruptas o ininteligibles por cualquier motivo quedarán anuladas y no serán aceptadas. La Inscripción constituye autorización, excepto donde esté prohibido por ley, para usar nombre/s y apellido/s, ciudad y estado de residencia, parecido, imagen y/o voz del Ganador en anuncios y campañas publicitarias, promociones, propaganda e iniciativas de publicidad y relaciones públicas, sin compensación adicional.

3.ELEGIBILIDAD: el Sorteo está abierto solamente para los residentes legales permanentes de los EE.UU. que se encuentren físicamente localizados y que residan en el área geográfica terrestre de recepción de la señal de transmisión de KXTX-TV Telemundo 39 dentro de los condados de Anderson, Bosque, Collin, Comanche, Cook, Dallas, Delta, Denton, Ellis, Erath, Fannin, Freestone, Hamilton, Henderson, Hill Hood, Hopkins, Hunt, Jack, Johnson, Kaufman, Lamar, Navarro, Palo Pinto, Parker Rains, Red River, Rockwall, Sommervell, Tarrant, Van Zandt, and Wise y que sean mayores de 18 años de edad al 26 de abril 2008. Los empleados de KXAS-TV, KXTX-TV, Telemundo Network Group LLC, NBC Universal, Inc., Susan G. Komen y sus respectivas casas matriz, empresas subsidiarias y coligadas, agencias de publicidad y promoción y sus familiares más allegados a saber (esposos, padres y madres, hijos e hijas, hermanos y hermanas y sus respectivos esposos) y/o toda otra persona residiendo en el mismo lugar con ellos, sean o no familiares, no son elegibles para inscribirse en este Sorteo.

4.SELECCIÓN DEL GANADOR Y NOTIFICACIÓN: el Ganador será seleccionado por Sorteo al azar de entre la totalidad de inscripciones elegibles recibidas por empleados de los Patrocinadores, el o alrededor del día 28 de abril 2008 y será notificado al teléfono y/o a la dirección de correo postal y/o a la dirección de correo electrónico que haya indicado en su inscripción. Se exigirá al Ganador llenar, firmar y notariar una declaración jurada de elegibilidad, un relevo de responsabilidad y, excepto donde esté prohibido, un relevo de publicidad dentro de los cinco (5) días de la notificación. El incumplimiento dentro de este periodo de tiempo resultará en descalificación y se seleccionará a un nuevo Ganador para recibir el Premio. Si no se puede contactar al Ganador eventual tras realizar un esfuerzo razonable; o si se determina que no es elegible o que no cumple o no puede cumplir con estas Reglas Oficiales; o si el Premio o la notificación del Premio son devueltas porque no pudieron ser entregadas, se descalificará al Ganador eventual y se podrá seleccionar en su reemplazo a un nuevo Ganador eventual entre las inscripciones elegibles restantes. Limitado a un (1) Premio por familia o grupo familiar.

5.PREMIO: se otorgará un (1) Premio a saber, un televisor HDTV de pantalla plana de 42”. El valor minorista calculado del Premio es de $1,100. Los Patrocinadores, a su absoluta discreción, se reservan el derecho a sustituir el Premio por otro de igual o mayor valor. Todos los impuestos y demás gastos, costos o tasas relacionadas con la aceptación y/o uso del Premio son responsabilidad exclusiva del Ganador. El Premio no puede ser transferido por el Ganador o canjeado por dinero en efectivo y es válido sólo por los servicios detallados más arriba, con ninguna sustitución de Premio permitida al Ganador. En caso que el Sorteo sea cancelado antes de otorgarse todos los Premios, o si un Premio es perdido o no es reclamado, si una notificación de Premio es imposible de entregar, o en caso de incumplimiento de cualquiera de estos requisitos, el Premio será perdido y los Patrocinadores podrán seleccionar al azar a otro Ganador entre las inscripciones elegibles restantes para entregarle el Premio correspondiente.

6.CONDICIONES: inscribiéndose en este Sorteo, los participantes acuerdan, en nombre propio y en representación de sus herederos, albaceas y administradores, (a) relevar y amparar a KXAS-TV, KXTX-TV, Telemundo Network Group LLC, NBC Universal, Inc., Susan G. Komen, y a sus respectivas casas matrices, empresas subsidiarias y afiliadas, empresas de capital y/o riesgo conjunto, agencias administrativas, agencias de publicidad y promoción y a sus respectivos accionistas funcionarios, directivos y empleados (conjuntamente las “Partes Relevadas”), contra toda responsabilidad, enfermedad, lesión, muerte, pérdida, litigio o daño que pudiera ocurrir, directa o indirectamente, con o sin negligencia, de la participación del participante en este Sorteo y/o su aceptación, posesión, buen o mal uso del Premio o de cualquier parte del Premio; (b) indemnizar a las Partes Relevadas contra cualquier y toda responsabilidad resultando o surgiendo del Sorteo, y, por el presente documento, reconocer que las Partes Relevadas no han extendido ni son responsables de ningún modo por extender garantía alguna, implícita o explicita, de hecho o en ley, relacionada con el Premio, incluyendo cualesquiera garantías extendidas exclusivamente por algún proveedor del Premio y acompañando el Premio; (c) de ser elegido Ganador, a permitir la publicación de su/s nombre/s y apellido/s en http://www.telemundodallas.com y todo uso que las Partes Relevadas hagan de su/ nombre/s y apellido/s, voz, imagen y/o parecido y semejanza en campañas publicitarias, promociones y publicidad/iniciativas de relaciones públicas sin compensación adicional y, al serle solicitado, a consentir por escrito a tal uso; y (d) respetar estas Reglas Oficiales renunciando a cualquier derecho a reclamar ambigüedad o error en las mismas, o en el propio Sorteo, y respetar asimismo las decisiones del Patrocinador las cuales son vinculantes y finales en todos los sentidos. El incumplimiento de estas Reglas Oficiales podrá resultar en la descalificación de este Sorteo.

7. TÉRMINOS ADICIONALES: los Patrocinadores se reservan el derecho de cancelar este Sorteo o de descalificar permanentemente de cualquier promoción a cualquier persona que los Patrocinadores sospechen o crean que ha violado estas Reglas Oficiales de manera intencional. Todo intento de perjudicar deliberadamente el Sorteo o su operación es ilegal y está sujeto a acción legal por parte de los Patrocinadores quienes podrían entablar demanda por daños y perjuicios en la máxima medida permitida por la ley. A su absoluta discreción, los Patrocinadores se reservan el derecho a cancelar o modificar el Sorteo si un virus de computadora, una falla u otra causa ajena a su control altera la administración, seguridad o funcionamiento correcto del Sorteo. En caso de cancelación, se otorgará el Premio a un Ganador seleccionado de entre todas las inscripciones elegibles y libres de sospecha que se hayan recibido antes del evento que haya exigido la cancelación. El aviso de cancelación se publicará en el sitio http://www.telemundodallas.com.

El incumplimiento de los Patrocinadores de cualquier condición de estas Reglas Oficiales debido a caso fortuito, huracán, guerra, incendio, disturbio social, terremoto, terrorismo, acciones de enemigos públicos o acción de autoridad competente, fuera del control de los Patrocinadores (con excepción del cumplimiento de códigos y regulaciones vigentes) y todo otro hecho de fuerza mayor, no será considerado una violación de estas Reglas Oficiales por parte de los Patrocinadores.

Por su parte, las Partes Relevadas no asumen responsabilidad alguna por perjuicio o daño a una computadora perteneciente a los participantes ni a ninguna otra persona en relación con, o resultando de, la participación en el Sorteo o la descarga de materiales o software en conexión con este Sorteo. Las Partes Relevadas no son responsables por fallas técnicas, de computadoras, de telecomunicaciones, de redes, o de electrónica de ninguna clase, o por trascripción errónea de información de inscripciones, errores en cualesquiera materiales de mercadeo o promoción, errores en estas reglas, o por cualquier error humano o electrónico, o por inscripciones que sean robadas, mal enviadas, alteradas, retrasadas por transmisiones de computadora, perdidas, demoradas, dañadas, o que no tengan franqueo postal.

CONFLICTOS: ESTE SORTEO ESTÁ REGIDO POR E INTERPRETADO SEGÚN LAS LEYES DEL ESTADO DE LA FLORIDA Y EL FORO Y LUGAR DESIGNADO PARA RESOLVER CONFLICTOS ESTARÁ UBICADO EN LA CIUDAD DE MIAMI, FLORIDA. SI UN CONFLICTO O RECLAMO NO PUEDE SER RESUELTO POR CONVERSACIONES DIRECTAS O MEDIACIÓN, SERÁ RESUELTO MEDIANTE ARBITRAJE FINAL Y VINCULANTE ADMINISTRADO POR JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., (“JAMS” POR SU SIGLA EN INGLÉS) SEGÚN SUS REGLAS Y PROCEDIMIENTOS SIMPLES O SEGÚN VERSIONES POSTERIORES DE LAS MISMAS (“REGLAS JAMS”). LAS REGLAS JAMS SERÁN RESPETADAS PARA PROCESO DE SELECCIÓN DE ÁRBITRO, EXCEPTO QUE DICHO ÁRBITRO DEBERÁ TENER EXPERIENCIA LEGAL Y LICENSIA PARA PRACTICAR DERECHO EN FLORIDA. LOS JUICIOS INICIADOS SEGÚN ESTE PÁRRAFO TOMARÁN LUGAR EN EL CONDADO DE MIAMI-DADE. LA REPARACIÓN/REMEDIO DE RECLAMOS ESTARÁ LIMITADA A DAÑOS Y PERJUICIOS SUFRIDOS ÚNICAMENTE, Y NINGUNA DE LAS PARTES Y EN NINGUN CASO, TENDRÁ DERECHO A RECOBRAR DAÑOS PUNITORIOS, EJEMPLARES, INCIDENTALES O INDIRECTOS, INCLUYENDO HONORARIOS DE ABOGADO/S, O CUALQUIER OTRO GASTO SIMILAR RELACIONADO CON LA PRESENTACIÓN DE UN RECLAMO, O A RESCINDIR ESTE ACUERDO O A PROCURAR MEDIDAS CAUTELARES O RECURSOS DE EQUIDAD.

RACE FOR THE CURE SWEEPSTAKES
Official Rules
April 26, 2008

1.PRELIMINARY INFORMATION: NO PURCHASE NECESSARY. Void outside the KXTX terrestrial geographic viewing area and where prohibited. Sweepstakes begins on April 26, 2008 at 6:00 A.M. and ends on April 26, 2008 at 10:00 A.M. (Sweepstakes Period”). All times in this Sweepstakes Central Time. Odds of winning depend upon the number of eligible entries received.

2.TO ENTER: To enter, visit the Telemundo 39 & NBC5 booth space at the Race for The Cure at the Sundance Square in Downtown Fort Worth and complete the registration form which includes name, address, telephone number, email address and other information. Once completed, the registration form must be placed in the sweepstakes entry box on location. All entries become the property of KXAS-TV, KXTX-TV, Telemundo 39, Susan G. Komen, Telemundo Network Group LLC, and NBC Universal, Inc., (“Sponsors”) and will not be acknowledged or returned. Entries must be received before 10:00 A.M. on April 26, 2008 to be eligible for the period’s drawing. You may enter once per day during the Sweepstakes Period. Multiple entries received from any person or email address thereafter will void all such additional entries. Entries generated by a script, macro or other automated means will be disqualified. Entries that are incomplete, garbled, corrupted or unintelligible for any reason are void and will not be accepted. Entry constitutes permission, except where prohibited by law, to use winner's name, city, state, likeness, image and/or voice for purposes of advertising, promotion and publicity without additional compensation.

3.ELIGIBILITY: Open only to permanent legal U.S. residents who are located and residing in the KXTX-TV Telemundo 39 terrestrial geographic viewing area in the counties of Anderson, Bosque, Collin, Comanche, Cook, Dallas, Delta, Denton, Ellis, Erath, Fannin, Freestone, Hamilton, Henderson, Hill Hood, Hopkins, Hunt, Jack, Johnson, Kaufman, Lamar, Navarro, Palo Pinto, Parker Rains, Red River, Rockwall, Sommervell, Tarrant, Van Zandt, and Wise and who are 18 years of age or older as of April 26, 2008. Employees of Sponsors, KXAS-TV, KXTX-TV, Telemundo Network Group LLC, NBC Universal, Inc., Susan G. Komen and their respective parent, subsidiary, affiliate companies and advertising and promotion agencies and members of their immediate families (spouses, parents, children, and siblings and their spouses) and/or persons living in the same households, whether related or not, are not eligible to enter Sweepstakes.

4.WINNER SELECTION AND NOTIFICATION: Winner will be selected in a random drawing by employees of Sponsors from all correct eligible entries on or about April 28, 2008 and will be notified by phone and/or mail and/or at the email address provided by winner. Winner will be required to return a completed, signed and notarized affidavit of eligibility and release of liability and, except where prohibited, a publicity release within 5 days of such notification. Noncompliance within this time period will result in disqualification, and an alternate winner for that prize will be selected. If potential winner cannot be reached after a reasonable effort has been exerted, if he/she is found to ineligible, if he/she cannot or does not comply with these Official Rules, or if his/her prize or prize notification is returned as undeliverable, potential winner will be disqualified and an alternate potential winner may be selected from the remaining eligible entries. Limit one prize per family or household.

5.PRIZE: There will be one (1) prize awarded, consisting of the following: 42” Plasma Flat Panel HDTV. Estimated Retail Value prize is $1,100. Sponsors reserve the right to substitute a similar prize of equal or greater value at its sole discretion. All taxes and all other expenses, costs or fees associated with the acceptance and/or use of any prize is the sole responsibility of winner. Prize cannot be transferred by winner or redeemed for cash and is valid only for the services detailed above, with no substitution of prize by winner. In the event this Sweepstakes is terminated before all prizes are awarded, if any prize is forfeited or unclaimed, if any prize notification is undeliverable, or in the event of non-compliance with any of these requirements, the prize will be forfeited and Sponsors will randomly select from remaining eligible entries an alternate winner for all remaining prize elements.

6.CONDITIONS: By entering this Sweepstakes, each entrant agrees for entrant and for entrant’s heirs, executors and administrators (a) to release and hold harmless KXAS-TV, KXTX-TV, Telemundo Network Group LLC, NBC Universal, Inc., Susan G. Komen, and their respective parent, subsidiaries, affiliates, joint venture companies, administrative agencies, advertising and promotion agencies and their respective officers, directors, and employees (collectively, “Released Parties”), from any liability, illness, injury, death, loss, litigation or damage that may occur, directly or indirectly, whether caused by negligence or not, from such entrant’s participation in this Sweepstakes and/or his or her acceptance, possession, use or misuse of the prize, or any portion thereof; (b) to indemnify Sponsors from any and all liability resulting or arising from the Sweepstakes and to hereby acknowledge that Sponsors have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to prizes, including express warranties provided exclusively by the prize supplier that are sent along with the prize; (c) if selected as a winner, to the posting of such entrant’s name on http://www.telemundodallas.com and the use by Released Parties of such name, voice, image and/or likeness for publicity, promotional and advertising purposes without additional compensation, and, upon request, to the giving of consent, in writing, to such use; and (d) to be bound by these Official Rules and to waive any right to claim any ambiguity or error in these Official rules or the Sweepstakes itself, and to be bound by all decisions of the judges and/or Sponsors, whose decisions are binding and final. Failure to comply with these rules may result in disqualification from this promotion.

7.ADDITIONAL TERMS: Sponsors reserve the right to terminate this Sweepstakes or permanently disqualify from any promotion any person it believes has intentionally violated these rules. Any attempt to deliberately damage the Sweepstakes or operation of the Sweepstakes is unlawful and subject to legal action by Sponsors who may seek damages to the fullest extent permitted by law. Sponsors reserve the right in its sole discretion to cancel or modify the Sweepstakes should any computer virus, malfunction or other cause beyond its control corrupt the administration, security or proper operation of the Sweepstakes. In the event of cancellation, prizes will be awarded from among all eligible, non-suspect entries received prior to the event requiring cancellation. Notice of cancellation will be posted at http://www.telemundodallas.com.

The failure of Sponsors to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Sponsors (excepting compliance with applicable codes and regulations) or other force majeure event will not be considered a breach of these Official Rules.

Released Parties assume no responsibility for any injury or damage to participants or to any other person’s computer relating to or resulting from entering or downloading materials or software in connection with this Sweepstakes. Released Parties are not responsible for telecommunications, network, electronic, technical or computer failures of any kind, for inaccurate transcription of entry information, errors in any promotional or marketing materials, errors in these rules, for any human or electronic error, or for entries that are stolen, misdirected, garbled, delayed by computer transmissions, lost, late, damaged or postage due.

DISPUTES: THE SWEEPSTAKES IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF FLORIDA, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN MIAMI, FLORIDA. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF (“JAMS RULES”). THE JAMS RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN FLORIDA. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN THE COUNTY OF MIAMI-DADE. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY’S FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.
